Lady Gaga and her legal team are planning to file a lawsuit against the London company behind “Baby Gaga” breast milk ice cream, AFP sources revealed today.
The Icecreamists Limited restaurant in London was given a letter by the singer’s lawyers from the firm Mischon de Reya to “cease and desist from in any other way associating with Lady Gaga any ice cream you are offering.” A deadline of 1600 GMT Wednesday was given to the breast milk ice cream makers.
“Baby Gaga” contains breast milk given by 15 women in response to an Internet advertisement. The initial batch of ice cream was sold out after just a few days from launch. Besides the ice cream bearing a similar name as the New York artist, servers of the product also dress up like Lady Gaga, who is known for wearing splashy garb.
As such the restaurant is accused of “taking unfair advantage of, and riding on the coattails of” the singer’s trademark image and looks which are “deliberately provocative and to many people, nausea-inducing.”
After it drew much attention, the breast milk ice cream was ordered stricken off the menu as health officials wanted to test some samples of the product.
Viruses and other microbes can survive in breast milk and officials wanted to ensure public health safety. But the ice cream makers said they used screening tests similar to ones employed by blood donation centers.
In order to sell more products, many businesses including restaurants and merchandisers have taken advantage of the huge popularity of Lady Gaga.
